Blue AI Website Terms of Use

The BlueAI website (the “Site”) and the Services (defined below) are operated by now.gg, Inc. (“Now.gg”, “we”, “us”). These Terms of Use (“Terms”) govern your access to and use of the Site.
IMPORTANT NOTICE: THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION.
BY CLICKING “I AGREE” BELOW, YOU ARE AGREEING TO DISPUTE ANY FUTURE CLAIMS THROUGH BINDING, INDIVIDUAL ARBITRATION INSTEAD OF A COURT TRIAL. Please read the Section entitled (Choice of Law; Arbitration) of these Terms carefully before proceeding.
PLEASE NOTE THAT YOUR USE OF AND ACCESS TO OUR SITE AND SERVICES ARE SUBJECT TO THE FOLLOWING TERMS; IF YOU DO NOT AGREE TO ALL OF THE FOLLOWING, YOU MAY NOT USE OR ACCESS THE SERVICES IN ANY MANNER.
Terms of Use
Welcome to the BlueAI Site. Please read on to learn the rules and restrictions that govern your use of our Site, BlueAI Partner Program, software, services, and applications we are making available to you (the “Services”). If you have any questions, comments, or concerns regarding these terms or the Services, please contact us at support@bluestacks.ai or at: now.gg, Inc., 2105 South Bascom Avenue, Suite 380, Campbell, CA 95008, USA.
These Terms are a binding contract between you and now.gg, Inc. You must agree to and accept all of the Terms, or you don’t have the right to use the Services. Your using the Services in any way means that you agree to all of these Terms, and these Terms will remain in effect while you use the Services. If these terms are considered an offer, acceptance is expressly limited to these terms. These Terms include the provisions in this document, as well as those in the BlueAI Privacy Policy.
Will these Terms ever change?
We are constantly trying to improve our Services, so these Terms may need to change along with the Services. We reserve the right to change the Terms at any time, but if we do so in any material way, we will bring it to your attention by placing a notice on the Site, by sending you an email, and/or by some other means.
If you don’t agree with the new Terms, you are free to reject them; unfortunately, that means you will no longer be able to use the Services. However, if you use the Services in any way after a change to the Terms is effective, that means you agree to all of the changes.
Except for changes by us as described here, no other amendment or modification of these Terms will be effective unless in writing and signed by both you and now.gg.
The order of documents
These Terms govern use of the Site and your Site account.
If you apply to and are admitted to the BlueAI Partner Program, the Partner Program Terms additionally apply, and they govern over these Terms for anything Program-related.
If you use BlueAI as a brand marketer or advertiser, the Advertiser Terms additionally apply.
The BlueAI Privacy Policy and BlueAI Cookie Policy describe how we handle data, and apply alongside these Terms.
Accounts
Signing in to the Site, use of the Services and participation in the BlueAI Partner Program uses a now.gg account. You are responsible for your account credentials and for activity under your account.
You must give accurate information and keep it current. The contact email on your account is how we reach you, including for legal notices.
You must be at least 18 years old to create an account on this site. The Site and the Services are not directed at children, and we do not knowingly collect data from anyone under 18. if you are a child or minor under 18, please do not attempt to register for the Site or send any personal information about yourself to us. If we learn we have collected personal information from a child or minor under 18, we will delete that information as quickly as possible. If you believe that a child or minor under 18 may have provided us personal information, please contact us at support@bluestacks.ai.
We may suspend or close accounts that breach these Terms, that we reasonably believe are fraudulent or automated, or where required by law.
BlueAI Partner Program Applications
Parts of the Site let you apply to the BlueAI Partner Program. Submitting an application creates no entitlement to admission or participation in the BlueAI Partner Program or to any payment. Admission into the BlueAI Partner Program and everything relating to it is governed by the BlueAI Partner Program Terms
What about my privacy?
now.gg takes the privacy of its users very seriously. For the current BlueAI Privacy Policy, please click Privacy Policy.
We use your mobile number only to send you authentication codes (OTPs) for login verification. We do not share your mobile number with third parties or affiliates for any reason, including marketing or promotional purposes.
What are the basics of using the Site and BlueAI Services?
You may be required to download and install certain software to your mobile device or computer, and sign up for an account, and select a password and user name (“now.gg User ID”). You promise to provide us with accurate, complete, and updated registration information about yourself. You may not select as your now.gg User ID a name that you don’t have the right to use, or another person’s name with the intent to impersonate that person. You may not transfer your account to anyone else without our prior written permission.
You represent and warrant that you are an individual of legal age to form a binding contract (or if not, you’ve received your parent’s or guardian’s permission to use the Services and gotten your parent or guardian to agree to these Terms on your behalf).
You will only use the Services for your own internal, personal, non-commercial use, and not on behalf of or for the benefit of any third party, and only in a manner that complies with all laws that apply to you. If your use of the Services is prohibited by applicable laws, then you aren’t authorized to use the Services. We can’t and won’t be responsible for your using the Services in a way that breaks the law.
You will not share your account or password with anyone, and you must protect the security of your account and your password. You’re responsible for any activity associated with your account.
Your use of the Services is subject to the following additional restrictions:
You represent, warrant, and agree that you will not use the Services or interact with the Services in a manner that:
Infringes or violates the intellectual property rights or any other rights of anyone else (including now.gg);
Violates any law or regulation, including any applicable export control and data privacy laws;
Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, offensive, graphically violent, pornographic, or otherwise objectionable;
Misrepresents your identity or affiliation, including by submitting false information in an application;
Jeopardizes the security of your now.gg account or anyone else’s (such as allowing someone else to log in to the Services as you);
Probes, disrupts, or overloads the site, or attempts to access accounts or data that are not yours
Attempts, in any manner, to obtain the password, account, or other security information from any other user;
Violates the security of any computer network, or cracks any passwords or security encryption codes, or attempt to post or transmit any information that constitutes a virus, bug, malicious code, or other harmful item;
Runs Maillist, Listserv, any form of auto-responder or “spam” on the Services, or any processes that run or are activated while you are not logged into the Services, or that otherwise interfere with the proper working of the Services (including by placing an unreasonable load on the Services’ infrastructure);
“Crawls,” “scrapes,” or “spiders” any page, data, or portion of or relating to the Services or otherwise accesses the Site using bots or for the purpose of bulk account creation (through use of manual or automated means), except for public search indexing;
Copies or stores any significant portion of the Site or Services, or use to resell or commercially exploit the Site or Services beyond normal personal use;
Decompiles, reverse engineers, or otherwise attempts to obtain the source code or underlying ideas or information of or relating to the Services.
A violation of any of the foregoing is grounds for termination of your right to use or access the Services. now.gg has a zero-tolerance policy against child pornography and will terminate any account and make reports to the appropriate law enforcement authorities about any user who publishes or distributes child pornography.
What rights does BlueAI retain and own?
The materials displayed or performed or available on or through the Services, including, but not limited to, text, graphics, digital and audio media, videos, data, articles, photos, images, illustrations, and so forth (all of the foregoing, the “Content”) are protected by copyright and/or other intellectual property laws. You promise to abide by all copyright notices, trademark rules, information, and restrictions contained in any Content you access through the Services, and you won’t use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell or otherwise exploit for any purpose any Content not owned by you, (i) without the prior consent of the owner of that Content or (ii) in a way that violates someone else’s (including now.gg) rights.
You understand that now.gg owns the Site and the Services. As between you and now.gg, (or other company whose marks appear on or via the Services), now.gg (or the respective company) is the owner and/or authorized user of any trademark, registered trademark and/or service mark appearing on the Services, and is the copyright owner or licensee of the Content and/or information on the Services, unless otherwise indicated. Except as otherwise provided herein, use of the Services (including any software) does not grant you a license to any Content, features or materials you may access on the Services and you may not modify, rent, lease, loan, sell, distribute, publish, transmit, participate in the transfer or sale of, reproduce (except as expressly provided in this Section), or create derivative works of such Content, features or materials, in whole or in part, or otherwise exploit any of the Services. Any commercial use of Services (including any software) is strictly prohibited, except as allowed herein or otherwise approved by us. Nothing on any Services should be construed to grant any license or right to use any now.gg marks or logos without our prior written consent.
The Services may allow you to copy or download certain Content; please remember that just because this functionality exists, doesn’t mean that all the restrictions above don’t apply - they do!
Do I have to grant consent to now.gg to communicate with me?
You acknowledge that our collection, use, and sharing of your information, including any information you submit in connection with an application to the BlueAI Partner Program, is subject to our Privacy Policy. You can unsubscribe or opt out from such communication at any time, but you may be unable to receive crucial account related communication. To unsubscribe, please visit https://now.gg/unsubscribe.html, enter your email address that you wish to unsubscribe and click on the “unsubscribe” button or click on the unsubscribe link in your email.
Do I have to grant any licenses to now.gg?
With respect to any feedback, suggestions, improvements, enhancements, and/or requests you submit to us (whether via direct email or otherwise), you hereby grant now.gg a worldwide, non-exclusive, royalty-free, fully paid, transferable, irrevocable and sublicensable license to use, copy, modify, adapt, display, perform, reproduce, distribute, and otherwise exploit such content in connection with the operation, improvement, and promotion of the Services and our business. This includes, without limitation, the use of such content for the training and development of machine learning and artificial intelligence models, whether generative or otherwise.
Please note that the foregoing license and any information you submit to us on the Site or through the Services is subject to our Privacy Policy to the extent they include your personally identifiable information.
What if I see something on the Services that infringes my copyright?
You may have heard of the Digital Millennium Copyright Act (the “DMCA”), as it relates to online service providers, like now.gg, being asked to remove material that allegedly violates someone’s copyright. Third Party Services:
You acknowledge and agree that the Services may enable you to access and use third party websites, content, materials, apps or services, including for processing payments (all of the foregoing, “Third Party Services”), and may contain links or connections to such Third Party Services that are not owned or controlled by now.gg. Your right to use Third Party Services is governed by the terms of the agreements for use of Third Party Services specified by such third party and not under this Terms of Use. You are solely responsible for procuring any and all rights necessary for you to access Third Party Services and for complying with any applicable terms or conditions thereof. now.gg does not make any representations or warranties with respect to Third Party Services or any third party providers. Any exchange of data or other interaction between you and a third party provider is solely between you and such third party provider and is governed by such third party’s terms and conditions.
We encourage you to be aware when you leave the Services and to read the terms and conditions and Privacy Policy of each Third Party Services that you visit or utilize. now.gg has no control over, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of or opinions expressed in any Third Party Services or by any third party that you interact with through the Services.
Will now.gg ever change the Services?
We’re always trying to improve the Services, so they may change over time. We may suspend or discontinue any part of the Services, or we may introduce new features or impose limits on certain features or restrict access to parts or all of the Services. We’ll try to give you notice when we make a material change to the Services that would adversely affect you, but this isn’t always practical. Similarly, we reserve the right to remove any Content or features from the Services at any time, in our sole discretion, and without notice.
What if I want to stop using now.gg?
You are free to stop using the now.gg Service at any time; please refer to our Privacy Policy as well as the licenses above, to understand how we treat information you provide to us after you have stopped using our Services.
now.gg is also free to terminate (or suspend access to) your use of the Services or your account, for any reason in our discretion, including your breach of these Terms. now.gg has the sole right to decide whether you are in violation of any of the restrictions set forth in these Terms.
Account termination may result in destruction of any Content associated with your account.
If you have deleted your account by mistake, contact us immediately at support@bluestacks.ai. We will try to help, but unfortunately, we can’t promise that we can recover or restore anything.
What else do I need to know?
Warranty Disclaimer. Neither now.gg nor its licensors or suppliers make any representations or warranties concerning the Services, including any Content contained in or accessed through the Services. We (and our licensors and suppliers) make no representations or warranties regarding suggestions or recommendations of third party services or products offered through the Services. THE SERVICES AND CONTENT ARE PROVIDED BY NOW.GG (AND ITS LICENSORS AND SUPPLIERS) ON AN “AS-IS” BASIS, WITHOUT WARRANTIES OR ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT USE OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Limitation of Liability. TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (INCLUDING, WITHOUT LIMITATION, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE) SHALL NOW.GG (OR ITS LICENSORS OR SUPPLIERS) BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION, OR (B) ANY AMOUNT, IN THE AGGREGATE, IN EXCESS OF THE GREATER OF (I) $100 OR (II) THE AMOUNTS PAID BY YOU TO NOW.GG IN CONNECTION WITH THE SERVICES IN THE TWELVE (12) MONTH PERIOD PRECEDING THIS APPLICABLE CLAIM, OR (C) ANY MATTER BEYOND OUR REASONABLE CONTROL. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATION AND EXCLUSIONS MAY NOT APPLY TO YOU.
Indemnity. To the fullest extent allowed by applicable law, You agree to indemnify and hold now.gg, its affiliates, officers, agents, employees, and partners harmless from and against any and all claims, liabilities, damages (actual and consequential), losses and expenses (including attorneys’ fees) arising from or in any way related to any third party claims relating to (a) your use of the Services (including any actions taken by a third party using your account), and (b) your violation of these Terms.
Assignment. You may not assign, delegate or transfer these Terms or your rights or obligations hereunder, or your Services account, in any way (by operation of law or otherwise) without now.gg’s prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without consent.
Choice of Law; Arbitration. These Terms are governed by and will be construed under the laws of the State of California, without regard to the conflicts of laws provisions thereof. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled in Santa Clara County, California, in English, in accordance with the Streamlined Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. (“JAMS”) then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes, who shall be selected from the appropriate list of JAMS arbitrators in accordance with such Rules. Judgment upon the award rendered by such arbitrator may be entered in any court of competent jurisdiction. Notwithstanding the foregoing obligation to arbitrate disputes, each party shall have the right to pursue injunctive or other equitable relief at any time, from any court of competent jurisdiction. For all purposes of these Terms, the parties consent to exclusive jurisdiction and venue in the state or federal courts located in, respectively, Santa Clara County, California.
Term and Termination. You may stop using the Site at any time. Your rights under the Services will terminate automatically without notice from now.gg if you fail to comply with any of these terms. Upon the termination, you shall cease all use of the Services (including any software) and destroy all copies, full or partial, of the software. All provisions of these Terms, which by their nature should survive termination, shall survive termination, including, without limitation, any obligation you have to pay us or indemnify us, any terms regarding ownership or intellectual property and proprietary rights, warranty disclaimers, any limitations on our liability, and terms regarding disputes between us.
Miscellaneous. You will be responsible for paying, withholding, filing, and reporting all taxes, duties, and other governmental assessments associated with your activity in connection with the Services, provided that now.gg may, in its sole discretion, do any of the foregoing on your behalf or for itself as it sees fit. The failure of now.gg to exercise, in any way, any right herein shall not be deemed a waiver of any further rights hereunder. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated, to the minimum extent necessary, so that these Terms shall otherwise remain in full force and effect and enforceable. Any claim or cause of action you may have with respect to now.gg or any Services must be commenced within one (1) year after the claim or cause of action arose. You and now.gg agree that these Terms are the complete and exclusive statement of the mutual understanding between you and now.gg, and that it supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of these Terms. You hereby acknowledge and agree that you are not an employee, agent, partner, or joint venture of now.gg, and you do not have any authority of any kind to bind now.gg in any respect whatsoever. You and now.gg agree there are no third party beneficiaries intended under these Terms.
