Blue AI Privacy Policy

We at now.gg know you care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our Privacy Policy. By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information in the following ways.

Remember that your use of the BlueAI website (the “Site”) and the BlueAI Partner Program (the “Program”), related software, services, and applications we are making available to you (collectively, the “Services”) is at all times subject to the BlueAI Website Terms of Use and BlueAI Partner Program Terms, which incorporate this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in those Terms.

Your information collected in connection with the Services and Program data is processed in the United States. If you are a resident of the European Union (“EU”), United Kingdom, Lichtenstein, Norway, or Iceland, you may have additional rights under the EU General Data Protection Regulation (the “GDPR”) with respect to your Personal Data (as defined in the GDPR). In this event, please refer to our GDPR Privacy Notice, as it applies to you too.

What does this Privacy Policy cover?

This Privacy Policy covers our treatment of personally identifiable information (“Personal Information”) that we gather when you are accessing or using our Services, but not to the practices of companies we don’t own or control, or people that we don’t manage. We gather various types of Personal Information from our users, as explained in more detail below, and we use this Personal Information internally in connection with our Services, including to personalize, provide, and improve our services, to allow you to set up a user account and profile, to administer your use of our Services, to contact you and allow other users to contact you, to fulfill your requests for certain products and services, and to analyze how you use the Services. In certain cases, we may also share some Personal Information with third parties, but only as described below.

As noted in the Blue AI Terms of Use and BlueAI Partner Program Terms, we do not knowingly collect or solicit personal information from anyone under the age of 18. If you are under 18, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn that we have collected personal information from a child under age 18, we will delete that information as quickly as possible. If you believe that a minor under 18 may has provided us personal information, please contact us at: support@bluestacks.ai.

Will now.gg ever change this Privacy Policy?

We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time as well, but we will alert you to changes by placing a notice on the Privacy Policy page, by sending you an email, and/or by some other means. Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is collected.

What Information does now.gg Collect?

Information You Provide to Us:

Account data: your now.gg sign-in identity and the email on it.

Application data: your answers to the Program application (country, hardware and availability answers, channel or platform links, contact email) and your consent records (what you agreed to, when, from where).

Application data for applicants who are not admitted to the Program is retained for 12 months and then deleted, unless you ask us to keep it on file for future programs.

Usage data: pages visited, device and browser information, and cookie data as described in the Cookie Policy.

Why we collect it

To operate the Services and your account (including Program participation).

To review Program applications and run the admissions and acceptance process.

To contact you about your Program application and, with your consent, about the Program.

To measure and improve the Services (consent for non-essential analytics, per the Cookie Policy).

To meet legal obligations and to prevent fraud and abuse (legitimate interests / legal obligation).

Additional Information the BlueAI app processes when it runs during the Program:

Identity and payment: your Program email, your PayPal address, and any tax information we are required to collect before paying you.

Task records: what Program Tasks were assigned to your Device, what the BlueAI app did, whether the Task succeeded, and the applicable Award that was paid.

Run telemetry: when the BlueAI app was available, session and step counts, durations, error states, and processing costs.

Screen captures: images of the virtual Android environment that BlueAI operates, taken during a Task, used to verify that the Task was completed as described. Captures are not taken of your host desktop, your other applications, or your files. More specifically Screen captures are:

Taken only during a Task, only of the virtual environment.

Used for verification of that Task, dispute handling, and abuse detection; not used for advertising. We may use this data to train and improve our AI models and the Services.

Retained for 6 months after the Task closes, then deleted.

If a Screen capture contains something it should not, contact us and we will delete it.

During the Program, Blue AI does not:

Capture your host Device desktop, webcam, or microphone.

It does not read files on your Device outside its own installation and working directories. It does not store your platform account passwords with us; sessions live on your Device.

Why we process Program data:

To assign, run, verify, and pay for Tasks (performance of the Program activities per the Partner Program Terms).

To detect manufactured activity and abuse (legitimate interests, and protecting the payment system).

To support you when something goes wrong.

To report campaign outcomes to the Advertisers that fund Tasks. Advertisers receive aggregate outcomes and verification results. They do not receive your identity, your contact details, or your PayPal address. Screen captures from a job are shared only with the Advertiser that paid for that job, for verification.

To meet tax, accounting, and sanctions-screening obligations (legal obligation).

What other general information is collected on the Services?

In general, we receive and store any information you knowingly provide to us. For example, through the Program application or registration process and/or through your account settings, we may collect Personal Information such as your email address. For another example, in the event you are selected as a potential Program participant, we may collect Personal Information such as your first name, last name, mailing address, telephone number, and banking information in order for you to perform Program activities. For yet another example, if you are approved as a Program participant, you may provide third-party account credentials to login to third party sites (such as Google, Facebook, Twitch, YouTube, Instagram or other third party sites) using their proprietary secure login forms in order to perform Program activities. By signing in to a third party site or service through now.gg Services, you understand some content and/or information in those accounts (“Third Party Account Information”) may be transmitted into your account with us, and that Third Party Account Information transmitted to our Services is covered by this Privacy Policy. Certain information may be required to register with us or to take advantage of some of our features.

We may communicate with you if you’ve provided us the means to do so. If you do not want to receive communications from us, please indicate your preference by clicking on the un-subscription or communication preferences link in the emails or communications.

Information Collected Automatically

Whenever you interact with our Services, we automatically receive and record information on our server logs from your browser or device. We may use this data to customize content for you that we think you might like, based on your usage patterns. We may also use it to improve the Services - for example, this data can tell us how often users use a particular feature of the Services, and we can use that knowledge to make the Services interesting to as many users as possible. Information we automatically receive may include the following:

Device Information: We may collect device-specific information (such as your hardware model, operating system version, unique device identifiers and mobile network information including phone number). We may associate your device identifiers or phone number with your now.gg account, and to verify compliance with these Terms and to detect fraud.

Log Information: When you use our Services (including while participating in the Program), we may automatically record or log technical and related information from your device, its software, and your activity using the Services. This may include:

The device’s Internet Protocol (“IP”) address;

Identification numbers associated with your devices (or synthetic anonymous IDs);

Locale preferences (country-level only);

Application activity such as- app installation, app uninstallation, app start, app play duration, app stop, app crashes, app network activity and app resource consumption;

Device event information such as crashes, system activity and hardware settings;

Date and time stamps associated with events; and

Other interactions with the Services and third party Advertisers.

Cookies: We use cookies to enhance your experience on our website. Cookies are pieces of information that are stored on the hard drive of your computer and are used for record-keeping purposes. Use of cookies facilitates web surfing by performing certain functions. You may refuse to accept cookies when you are alerted to their existence by us or by activating the setting on your browser, which allows you to refuse the setting of cookies. However, if you select this setting you may be unable to access certain parts of our website.

The Services may use the following cookies:

A cookie which recognizes a user’s browser type, browser language, the date and time of a user’s request and referral URL;

A cookie which identifies the web page visited before you came to our website; and

A cookie which logs information you search for on our website.

Our advertising partners may also transmit cookies to your browser or device, when you click on ads that appear on the Services. Also, if you click on a link to a third party website or service, a third party may also transmit cookies to you. Again, this Privacy Policy does not cover the use of cookies by any third parties, and we aren’t responsible for their privacy policies and practices. Please be aware that cookies placed by third parties may continue to track your activities online even after you have left our Services, and those third parties may not honor “Do Not Track” requests you have set using your browser or device.

Third Party App Information: When you download and install applications from a third party, or when you permit such third party applications to be updated, we may record information about the source, such as the name of the app store or app market, its IP address, the application version number, or any unique application identification number associated with them.

Geo-location Information: When you use a location-enabled app and if you have opted in for the app to access your location, we may collect, process and retain information about your actual location. We may use geo-location information to the greatest extent permitted by law. Some devices allow applications to access real-time location-based information (for example, GPS). The location data is collected anonymously in a form that does not personally identify you and is used by us to provide and improve location based products and services. By using a location-enabled app, you consent to us processing information about your actual location.

Information Collected From Other Websites and Do Not Track Policy Through cookies we place on your browser or device, we may collect information about your online activity after you leave the websites of our Services. Just like any other usage information we collect, this information allows us to improve the Services and customize your online experience, and otherwise as described in this Privacy Policy. Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. Our Services do not support Do Not Track requests at this time.

Third Party Processors and Information Recipients for the Program

We use third parties to run the Program, including:

now.gg / BlueStacks infrastructure: sign-in and app distribution.

Google Cloud: hosting, storage, and Task orchestration (US).

LLM providers via our gateway: Task steps are executed by large language models; the content of a job step (including screen captures needed for the model to act) is processed by the model provider for the duration of processing.

PayPal: payouts. PayPal’s own privacy policy applies to your PayPal account.

Tax and compliance vendors: where required for reporting and sanctions screening

Will now.gg Share Any of the Personal Information it Receives?

We do not rent or sell your Personal Information in personally identifiable form to anyone, provided certain Personal Information may be transferred in connection with business transfers, as described below. We may share your Personal Information with third parties as described in this section:

Information that’s no longer personally identifiable. We may anonymize your Personal Information so that you are not individually identified, and provide anonymized information to our partners. We may also provide aggregate usage information to our partners (or allow partners to collect that information from you), who may use such information to understand how often and in what ways people use our Services, so that they, too, can provide you with an optimal online experience. However, we never disclose aggregate usage information to a partner in a manner that would identify you personally, as an individual.

To gain a better understanding of how our users use our Services, now.gg may track user actions (such actions may include, without limitation, user sessions started successfully; user sessions that could not be started; user session duration; user interactions with our UI performed during the sessions; Android apps started successfully; Android apps failed to start; and Android apps started but failed midstream) and record or report them over the Internet to a central analytics database. We use Google Analytics to grow our business, to improve or develop our products, to monitor and analyze use of our Services, for our technical administration, to increase the functionality and user-friendliness of our Services, and to verify that users have the authorization needed for us to process their requests. Advertisers: We allow advertisers and/or merchant partners participating in the Program (“Advertisers”) to choose the demographic information of users who will see their Program Task requests and/or promotional offers and you agree that we may provide any of the information we have collected from you an Advertiser, in order for that Advertiser in connection with the Program to select the appropriate audience for those Tasks and/or offers. You will not receive unsolicited ads from Advertisers which are not related to Program initiatives.

Agents: We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you; for example, we may use certain third party companies and individuals to help us provide, analyze, and improve our Services (including but not limited to data storage, maintenance services, database management, web analytics and payment processing) for purposes of and under obligations to adequately safeguard the information. Unless we tell you differently, our agents do not have any right to use the Personal Information we share with them beyond what is necessary to assist us or perform the tasks on our behalf.

Business Transfers: We may choose to buy or sell assets, and may share and/or transfer customer information in connection with the evaluation of and entry into such transactions. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party.

Compliance with Laws; Protection of now.gg and Others: We reserve the right to access, read, preserve, and disclose any information that we reasonably believe is necessary to (a) comply with law or court order; (b) enforce or apply our BlueAI Website Terms of Use and BlueAI Partner Program Terms and other agreements; (c) or protect the rights, property, or safety of now.gg , our employees, our users, or others; or (d) prevent fraud or abuse of now.gg , our employees, our users, or others.

Is Personal Information about me secure?

Your account is protected by a password for your privacy and security. If you access your account via a third party site or service, you may have additional or different sign-on protections via that third party site or service. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password and/or other sign-on mechanism appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account. If we receive instructions using your now.gg account information we will consider that you have authorized the instructions.

We endeavor to protect the privacy of your account and other Personal Information we hold in our records. But unfortunately, no method of electronic transmission or storage is 100% secure, so we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

What Personal Information can I access?

Please keep your information up to date and accurate. Through your account settings or by using features of our Services, you may access, and, in some cases, edit or delete the following information you’ve provided to us:

How do I request deletion of my Personal Data?

You have the right to request that we delete the Personal Data that we have collected about you. This right is subject to certain exceptions: for example, we may need to retain your Personal Data to provide you with the Services or complete a transaction or other action you have requested. If your deletion request is subject to one of these exceptions, we may deny your deletion request.

To request deletion of your Personal Data as described above, you or your Authorized Agent (defined below) must send us a request that (1) provides sufficient information to allow us to verify that you are the person about whom we have collected Personal Data, and (2) describes your request in sufficient detail to allow us to understand, evaluate and respond to it. Each request that meets both of these criteria will be considered a “Valid Request.” We may not respond to requests that do not meet these criteria. We will only use Personal Data provided in a Valid Request to verify your identity and complete your request. You do not need an account to submit a Valid Request.

We will work to respond to your Valid Request within 30 days of receipt. We will not charge you a fee for making a Valid Request unless your Valid Request(s) is excessive, repetitive or manifestly unfounded. If we determine that your Valid Request warrants a fee, we will notify you of the fee and explain that decision before completing your request.

You may also authorize an agent (an “Authorized Agent”) to exercise your rights on your behalf. To do this, you must provide your Authorized Agent with written permission to exercise your rights on your behalf, and we may request a copy of this written permission from your Authorized Agent when they make a request on your behalf.

California Resident Rights

If you are a California resident, you have the rights set forth in this section. Please see the “Exercising Your Rights” section below for instructions regarding how to exercise these rights. Please note that we may process Personal Data of our customers’ end users or employees in connection with our provision of certain services to our customers. If we are processing your Personal Data as a service provider, you should contact the entity that collected your Personal Data in the first instance to address your rights with respect to such data.

If there are any conflicts between this section and any other provision of this Privacy Policy and you are a California resident, the portion that is more protective of Personal Data shall control to the extent of such conflict. Access

You have the right to request certain information about our collection and use of your Personal Data over the past 12 months. In response, we will provide you with the following information:

The categories of Personal Data that we have collected about you.

The categories of sources from which that Personal Data was collected.

The business or commercial purpose for collecting or selling your Personal Data.

The categories of third parties with whom we have shared your Personal Data.

The specific pieces of Personal Data that we have collected about you.

If we have disclosed your Personal Data to any third parties for a business purpose over the past 12 months, we will identify the categories of Personal Data shared with each category of third party recipient. If we have sold your Personal Data over the past 12 months, we will identify the categories of Personal Data sold to each category of third party recipient.

Deletion

You have the right to request that we delete the Personal Data that we have collected about you. Please see section How can I request deletion of my Personal Data? above for the deletion request process.

Personal Data Sales Opt-Out and Opt-In

We will not sell your Personal Data, and have not done so over the last 12 months. To our knowledge, we do not sell the Personal Data of minors under 16 years of age.

We Will Not Discriminate Against You for Exercising Your Rights Under the CCPA

We will not discriminate against you for exercising your rights under the CCPA. We will not deny you our goods or services, charge you different prices or rates, or provide you a lower quality of goods and services if you exercise your rights under the CCPA. However, we may offer different tiers of our Services as allowed by applicable data privacy laws (including the CCPA) with varying prices, rates or levels of quality of the goods or services you receive related to the value of Personal Data that we receive from you.

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to ask us for a notice identifying the categories of Personal Information which we share with our affiliates and/or third parties for marketing purposes, and providing contact information for such affiliates and/or third parties. If you are a California resident and would like a copy of this notice, please submit a written request to: support@bluestacks.ai.

Nevada Resident Rights

If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties who intend to license or sell that Personal Data. You can exercise this right by contacting us at privacy@bluestacks.ai with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account. Please note that we do not currently sell your Personal Data as sales are defined in Nevada Revised Statutes Chapter 603A.

What do I need to know about my data if I am located in the EU?

If you are a resident of the European Union (“EU”), United Kingdom, Lichtenstein, Norway, or Iceland, you may have additional rights under the EU General Data Protection Regulation (the “GDPR”) with respect to your Personal Data (as defined in the GDPR). In this event, please refer to our GDPR Privacy Notice, as it applies to you too.

What choices do I have?

You can always opt not to disclose information to us, but keep in mind you may need to provide some information to us in order to take advantage of some of our features.

You may be able to add, update, or delete information as explained above. When you update information, however, we may maintain a copy of the unrevised information in our records. You may stop using our products by disconnecting your third party accounts from our Services or uninstalling our software from your devices. After you disconnect your third party accounts or uninstall our software, we do not have access to or any control over the contents or information in your accounts with third party products or services. Some information may remain in our records after your deletion of such information from your account. We will retain your information for as long as your account is active or as needed to provide you with Services or as required by law (whichever is longest). We may retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements. Also, we may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally.
